Dezerve Counseling, LLC — Behavioral Health IOP & Peer Support Services


THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.


Dezerve Counseling, LLC (referred to in this Notice as “we,” “us,” or “our”) provides Intensive Outpatient Program (IOP) services and Peer Support in Arizona. We are committed to protecting the privacy of your personal health information (“PHI”). This Notice explains your rights and our legal duties regarding your PHI under the Health Insurance Portability and Accountability Act (HIPAA) and applicable Arizona law.


Our Responsibilities


We are required by law to:


· Maintain the privacy and security of your PHI.

· Provide you with this Notice of our legal duties and privacy practices.

· Notify you in the event of a breach of your unsecured PHI.

· Follow the terms of this Notice while it is in effect.


How We May Use or Disclose Your Health Information


We use and disclose your PHI for treatment, payment, and healthcare operations, and as otherwise permitted or required by law. Examples include:


· Treatment: To provide, coordinate, or manage your IOP and Peer Support services, communicate with other treating providers, and make referrals.

· Payment: To bill and collect payment from you, your insurance, or another party.

· Healthcare Operations: For quality assessment, staff training, business planning, and improving our services.

· Business Associates: We may share PHI with third parties who perform services on our behalf (such as billing, IT, or transcription) under strict confidentiality agreements.

· As Required by Law: Including reporting to public health authorities, responding to court orders, or preventing serious threats to health or safety.

· With Your Authorization: For any purpose not described above, we will obtain your written authorization, which you may revoke at any time.


Your Rights Regarding Your PHI


You have the right to:


· Access your records, with limited exceptions.

· Request amendments to your PHI if you believe it is incorrect or incomplete.

· Receive an accounting of certain disclosures made in the past six years.

· Request restrictions on certain uses and disclosures; we will comply when required by law.

· Request confidential communications (e.g., by alternate means or at an alternate address).

· Receive a paper copy of this Notice upon request.

We reserve the right to update this Notice. Any changes will apply to all PHI we maintain. The current Notice is posted at our facility and available upon request.
